Privacy Policy
1. SCOPE AND SERVICES
This privacy policy (the "Policy") applies when you use the Services (as defined below) offered by iLLOGIKA Studios, Inc. ("iLLOGIKA", "we", "us" or "our"). Our Services include our websites (the "Websites"), our mobile applications, games and products (the "Apps"), and our social networks, all of which are collectively referred to as the "Platforms".
This Privacy Policy does not apply to the collection, use or disclosure of information through applications not published by iLLOGIKA. By using the Platforms or interacting with us offline, including by using the services and resources made available or enabled via the Websites or Apps by iLLOGIKA (the "Services"), you signify your consent to our Privacy Policy, to the collection, use and disclosure practices of your data (the "Data", see the scope of their definitions in Section 2.), and to the other activities described herein. If you do not agree, please cease all use of our Platforms.
2. TYPES OF INFORMATION COLLECTED THROUGH OUR SERVICES
We may collect, use, store and disclose various types of Personal Data about you, including the following:
(i) Information you provide.
iLLOGIKA collects the information you provide through its Platforms, for example when you contact us to apply for a job, for feedback, or to request information or assistance on an App.

Contact Data, including your first and last name, e-mail address, home address and telephone number;

Demographic Data, including your age, gender, preferred language and country of residence;

Resume Data, including your work history, transcript and references, to the extent necessary to consider you for a job opening if you submit a job application to us;

Content, including the content and photos of messages you send us (such as your portfolio, comments, questions or requests for assistance);
You may choose to voluntarily submit information to us through the Websites that we do not request, in which case you are solely responsible for such information.
(ii) Information collected automatically from devices.
iLLOGIKA automatically collects information about your use of our Platforms to help us improve our Services or for other purposes described in this Privacy Policy. We automatically collect the following categories of information:

Location Data, including location derived from IP address or Data;

Technical Data: Internet Protocol (IP) address, Connection Data, browser and plug-in information, time zone, operating system and platform and any other technology on the devices you use to access our Services;

Usage Data: information and preferences about how you use our Services (e.g. your game history, score and level);

Content Data: information stored on your device, including friend lists and login information.

Digital application store identifier: the identifier assigned to a device by the provider of the digital application distribution platform from which the App is downloaded (e.g. Google Play and the Apple App Store);

The advertising identifier, which is a unique identifier assigned to the device by the device's operating system (for example, IDFA on iOS and GPS ADID on Android);

Browser cookies. Cookies used on our Websites contain information used for navigation and analysis of the Websites and may be used in combination with pixels, as described below;

Pixels (also known as web beacons). Pixels are used in combination with cookies to track the activity of a particular browser on a particular device;

Transaction Data: information relating to payments received or sent, and to purchases;

Marketing/communication Data: your marketing preferences received from us or from third parties, as well as your communication preferences;

Profile Data: your username and password, purchase history, interests, preferences, comments, contests, survey responses, information you provide when contacting our customer service, date of birth, gender;

Application technologies, which are technologies that are not browser-based and cannot be controlled by browser settings. For example, our Apps include SDKs (or software development kits), which are codes that send information about the use of our Apps to a server. These SDKs enable us to analyze the performance of our Apps and our marketing campaigns, to advertise in our Apps, to provide assistance to App users and to offer them additional functionalities;

Information from other sources. We may also collect information from other sources. To the extent that we combine information from other sources with information we have collected through our Applications, we will treat the combined information in accordance with the practices described in this Privacy Policy, plus any additional restrictions imposed by the source of the Data. The source categories may vary over time, but primarily include social network services, when you engage with our content, reference our Apps, or when you give us permission to access information from social network services. If you use one of our Apps in connection with a social network service (such as Facebook), we may receive information about you from that social network service, in accordance with that social network service's terms of use and privacy policy and the privacy settings you have defined with it. For example, if you link an App to your Facebook account, Facebook provides the App (and us) with information that may include your name, profile photo, gender, networks, Facebook ID, friends list, email address, location, birthday and user stream, as well as other information you store on Facebook. We may make some of this information visible to you and other users of the App (for example, your profile name or Facebook user ID and photo), and we may add this information to information we have already collected from you through the App. If you choose to share information about your activities in the App by posting it on the social networking services you use in connection with the App, we share information with them in accordance with your choice in the App;

Information from one of our advertisements. When you click on our advertisements or download our Apps after clicking on our advertisements. We may receive information from advertising networks and vendors who create and place advertisements for us on third-party websites, apps and other online services ("our Ads"), as well as from service providers and vendors with whom we work for ad attribution purposes. This may include information about the overall effectiveness of iLLOGIKA's advertising campaigns, such as general information about the number of people who clicked on one of our advertisements and downloaded one of our Apps via our advertisements, as well as information about how you interacted with one of our advertisements, and when you clicked on one of our advertisements, installed one of our Apps, launched and used the App after viewing or clicking on one of our advertisements. We, our ad networks and our suppliers, may collect this information through cookies and other tracking technologies embedded in our Ads, and we may combine information collected through our Ads with other information we collect through our Apps.
3. USE OF COLLECTED INFORMATION
iLLOGIKA collects and uses information for professional and business purposes in accordance with the practices described in this Privacy Policy.
3.1. Purposes of use and processing

To register you as a customer;

To process, manage and deliver your order, to process payments, collect amounts due or initiate legal proceedings in the event of non-compliance with payment terms;

To manage our relationship with you and to send notices regarding the terms of use of our Platforms or this Policy;

To enable your participation in a prize draw, competition or survey;

To administer and improve our Services and user experience, provide customer service, troubleshooting or technical support on our Platforms and products;

To provide relevant and personalized content;

To measure and analyze the effectiveness of our ads;

To advertise and promote and study how our customers use our Services, in order to develop and grow our business and guide our marketing strategy;

To communicate newsletters, information, promotions or new releases;

To process applications for employment with our company;

To provide and operate the Services, in particular to save your scores and levels, or to match you with other players (matchmaking), by evaluating your progress in games, allowing you to search for your friends and establishing rankings;

To protect the integrity of our Platforms and Services, in particular by verifying your identity, detecting and preventing fraud, cheating or hacking;

To comply with legal obligations or to respond to accounting, financial and tax audits, internal audits or government audits.
3.2. Legal basis for processing
In accordance with Law 25 in Quebec, and other similar laws (such as the UK GDPR in the United Kingdom, the evFADP in Switzerland, the LGPD in Brazil or the RGPD in the European Economic Area), we generally process your personal information on the following legal basis:

3.3. Different purposes
We will only use your personal Data for the purposes for which it was collected. If we need to use your personal Data for another purpose, we will notify you and explain the legal basis for doing so. Where required or permitted by law, we may process your personal Data without notifying you or obtaining your consent.
4. INFORMATION SHARING AND DISCLOSURE
iLLOGIKA shares the information we collect in accordance with the practices described in this Privacy Policy for the limited purposes described above, and we will obtain your consent to do so when required by applicable law. The types of entities to which we disclose and share information are as follows:
4.1. Internal third parties:
iLLOGIKA's subsidiaries may access your personal Data in order to provide the Services and, where applicable, will use your personal Data in accordance with this Policy.
4.2. External third parties:

Suppliers and service providers. We may engage suppliers and service providers to provide services to us or to provide services on our behalf, such as support for the operations of our business, Platforms or Services (such as cloud-based email providers, Website hosting, payment processing, application marketplaces or technical support processing), as well as related offline business product support, Data storage and other services, or for recruitment support via recruitment agencies, recruiters or recruiting platforms. In the course of providing their services, they may access, receive, store or otherwise process personal information on our behalf.

Advertising networks and analytics providers. We work with third-party companies that provide us with advertising, ad campaign measurement, online and mobile analytics and related Services (with your consent, where required by applicable law) and other Services. They may use the information we provide or make available to them to help us better reach consumers with relevant advertising and to measure and improve our advertising campaigns, or to better understand how users interact with our Services. In addition, these advertising and analytics companies may combine information collected from us and our Services with information about you collected by themselves and from third parties, in order to make inferences about you and your interests, to better tailor advertising and content to your needs, and to collect related metrics.

Platforms where our games and applications are sold, such as Steam, Google Play Store or App Store. These platforms have their own privacy policies.

Legal and governmental authorities. We may also disclose your personal information if we believe that we are required to do so by law or that it is reasonably necessary to comply with legal process, including when we believe it is necessary or appropriate to disclose personal information to law enforcement authorities, other governmental or regulatory authorities, or the courts (in any relevant jurisdiction, and worldwide).

Potential buyers and auditors. Your personal information may be disclosed in connection with a proposed transaction, merger, sale or transfer of iLLOGIKA assets, acquisition, bankruptcy or similar event. We may also share certain personal information as necessary prior to the consummation of such a transaction, for example with third party lenders, auditors and advisors, including attorneys and consultants, as part of due diligence, or as necessary to plan the transfer, provided that we inform the purchaser that they may only use your personal information for the purposes described in this Privacy Policy.
Generally, by providing us with information, we will assume that you consent to the collection, use and disclosure of that information for the purposes identified at the time we collect the information from you or as otherwise described in this Privacy Policy.
We may also collect, use, store and disclose aggregate Data, such as statistical or demographic Data, for any purpose. Aggregate Data may be derived from your personal Data but is not considered personal Data as it does not reveal (directly or indirectly) your identity.
Our Apps may also allow you to post content from our Apps or related to your use of our Apps on social networking Services. You acknowledge and agree that you are solely responsible for your use of such social networking Services, and that it is your responsibility to review the terms of use and privacy policy of the third-party provider of each such social networking service. We are not and will not be responsible for: (i) the availability or accuracy of such social network services; (ii) the content, products or services of such social network services; or (iii) your use of such social network services.
5. NON-TRANSMISSION OF YOUR PERSONAL DATA
Where we are required to collect your personal Data by law or under the terms of a contract we have entered into with you and you fail to provide us with the required Data, we may no longer be able to perform the contract we have entered into with you or are trying to enter into with you (e.g., where this is necessary in order to provide you with the Services). In this case, we may have to cancel the Services and/or you may no longer be able to use them.
6. RETENTION PERIOD FOR PERSONAL DATA
We retain your personal Data only for the periods required to fulfill the purposes for which it was collected and to meet our reporting obligations.
In certain circumstances, we will anonymize your personal Data (so that it is no longer possible to associate it with you) for research or statistical purposes, in which case we may use the information indefinitely without informing you. Otherwise, the personal Data will be deleted.
7. THIRD PARTY LINKS
Our Services may include links to third-party websites, plug-ins and applications. Clicking on these links or activating these connections in order to use these third-party products or services may allow third parties to collect or share Data about you or result in these third parties requesting that you provide them with your personal Data. We do not control these third-party websites and are not responsible for their privacy policies. If you click on these links or use the services of a third party, you will leave our Services.
8. YOUR RIGHTS
8.1. Rights and choices
Under certain circumstances, and depending on where you live, you may have rights under Data protection laws regarding your personal Data, including the following rights:

However, we may charge you a reasonable fee if your request is clearly unfounded, recurring or excessive. Otherwise, we may refuse your request in these circumstances. We may also ask you for specific information about yourself to help us confirm your identity and ensure your right of access to your personal Data. This is a security measure to ensure that your personal Data is not disclosed to anyone who is not entitled to receive it. Please note that we will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements. Please also note that exercising these rights may result in our Platforms not functioning fully or correctly.
8.2. Marketing unsubscription
At any time, you may ask us to stop sending you marketing messages. Your unsubscribing from marketing communications will have no impact on the personal Data you have provided to us as a result of purchasing a product/service, registering a warranty, product/service experience or other transactions.
8.3. Choice of tracking technologies
(i) Cookies and pixels. Most browsers accept cookies by default. If you prefer not to receive cookies, you can modify your browser settings to refuse or delete cookies. If you choose to refuse cookies in your browsers, some parts of our Websites may not function properly.
(ii) App Technologies. You can stop any collection of information through an App by uninstalling the App. You can also reset your device's advertising ID at any time through your device settings, which is designed to allow you to limit the use of information collected about you. Please be aware that if you disable or remove tracking technologies, some parts of the Platforms may not function properly.
8.4. Analysis and advertising
Our Website may use, where appropriate, tools such as Google Analytics, Facebook or YouTube. These tools collect Data through tracking technologies such as cookies, which may be used in accordance with their privacy policies. Please consult the privacy policies of these entities to learn more about their practices and available opt-out options.
9. CHILDREN UNDER 13
The Services provided by iLLOGIKA are not intended for children under the age of 13. No child under the age of 13 may provide information on our Services. We do not knowingly collect personal Information from children under the age of 13. If you are under 13, please do not use or provide any information on our Services or through any of their features (including not registering), do not make any purchases through our Services, do not use any public or interactive comment features on our Services and do not provide us with any information about yourself, including your name, address, telephone number, e-mail address or any pseudonym or username you may use. If we learn that we have collected or received personal information from a child under the age of 13 without parental consent, we will delete that information.
10. PROTECTION OF INFORMATION AND PERSONAL DATA
We implement and maintain reasonable and appropriate administrative, physical and technical security measures designed to help protect the security, integrity, accuracy and confidentiality of the information you have provided against loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. Despite our best efforts, no security measure is ever perfect or impenetrable. For this reason, iLLOGIKA will notify users of a Data breach when iLLOGIKA deems it reasonably necessary in accordance with applicable law.
11. LOCATION AND TRANSFER OF PERSONAL DATA
Your personal information may be transferred to and processed in countries other than the one in which you reside. iLLOGIKA is located in Montreal, Canada. If you access the Platforms, please be aware that information collected through the Platforms may be transferred to, processed, stored and used in Canada and other jurisdictions where our service providers operate. Some of these jurisdictions (including Canada or the United States) may not offer equivalent levels of Data protection to the jurisdiction of your country of residence. By using the Platforms or providing information, you therefore consent to the transfer, processing, use, sharing and storage of information about you in Canada and other jurisdictions as set out in this Privacy Policy.
12. CHANGES TO THIS PRIVACY POLICY
We regularly update our Policy. This Policy may change from time to time, in which case the changes will be posted on this page and, if appropriate, you will be notified by e-mail or when you log in to any of our Services. The new Policy may be displayed on a screen and you may be required to read and accept it before continuing your use of the Services. Your continued use of our Services will constitute your acceptance of any changes to this Policy.
